Terms of Service

1. Introduction & Acceptance
Welcome to Juxtravel. By accessing or using our platform at juxtravel.com and its associated applications (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.
These Terms constitute a legally binding agreement between you and Hostsphere India Pvt Ltd("we", "us", "our"), the company that owns and operates Juxtravel.
2. Definitions
- "Platform" means the Juxtravel website, mobile applications, and all related services
- "Guest" means any user who searches for, books, or stays at a property listed on the Platform
- "Host" means any user who lists a property for booking on the Platform
- "Property" means any accommodation listed on the Platform, including villas, farmhouses, cottages, homestays, and other stay types
- "Booking" means a confirmed reservation made through the Platform
- "Service Fee" means the fee charged to guests for use of the Platform (currently 3% of the booking subtotal)
- "Commission" means the fee charged to hosts for use of the Platform (currently 5% of the booking subtotal)
3. Eligibility
To use Juxtravel, you must:
- Be at least 18 years of age
- Be an Indian resident or hold a valid government-issued identification document
- Provide accurate, current, and complete information during registration
- Have the legal capacity to enter into binding agreements
We reserve the right to refuse service, terminate accounts, or cancel bookings at our discretion if eligibility requirements are not met.
4. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account
- Each person may maintain only one active account on the Platform
- You must provide accurate and truthful information during registration and keep it updated
- You must notify us immediately of any unauthorised use of your account by contacting hello@juxtravel.com
- We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently
5. Guest Terms
- Booking process: Bookings are made by selecting dates, providing guest details, and completing payment through the Platform. A booking is confirmed only after successful payment verification.
- Payment obligations: You agree to pay the full booking amount including applicable taxes, service fees, and any additional charges disclosed at the time of booking.
- Property rules:You must comply with the property's house rules, check-in/check-out times, and any reasonable instructions from the host. You are liable for any damage caused to the property during your stay.
- Accurate information: You must provide accurate guest details including the number of guests. Misrepresenting occupancy may result in booking cancellation without refund.
- Reviews: Reviews must be honest, fair, and based on your actual experience. We reserve the right to remove reviews that are fraudulent, abusive, or violate our guidelines.
6. Host Terms
- Listing accuracy: You must provide accurate, up-to-date descriptions, photos, pricing, and availability for your property. Misleading listings may be removed.
- Verification: All properties must pass our verification process, which may include video verification, document checks, and periodic re-verification.
- Booking acceptance: You must honour confirmed bookings. Repeated cancellations by hosts may result in listing suspension or removal.
- Hosting standards: Properties must meet minimum cleanliness, safety, and amenity standards as communicated by Juxtravel. You must maintain valid licences, permits, and insurance as required by local law.
- Commission: Hosts agree to pay a 5% commission on the booking subtotal for each completed reservation facilitated through the Platform.
7. Booking & Payments
- All prices on the Platform are listed in Indian Rupees (INR)
- A service fee of 3% is added to guest bookings
- A commission of 5% is deducted from host payouts
- Goods and Services Tax (GST) is applied as applicable based on property classification and booking value
- All payments are processed securely through Razorpay. Juxtravel does not store your credit/debit card details
- Bookings are confirmed only after successful payment verification by our payment processor
- Host payouts are processed according to the payout schedule communicated in the host dashboard
8. Cancellation & Refunds
Each property may set one of the following cancellation policies, which is displayed at the time of booking:
Flexible
Full refund if cancelled at least 24 hours before check-in. After that, the first night is non-refundable.
Moderate
50% refund if cancelled at least 5 days before check-in. No refund for cancellations within 5 days of check-in.
Strict
No refund for cancellations made at any time. Full amount is non-refundable once the booking is confirmed.
Refunds, where applicable, are processed within 7–10 business days to the original payment method. Service fees are non-refundable except in cases where Juxtravel cancels a booking due to host fault or safety concerns.
9. User Conduct
You agree not to engage in any of the following prohibited activities:
- Fraud: Providing false information, using stolen payment methods, or impersonating others
- Harassment: Threatening, abusing, or discriminating against hosts, guests, or our team
- Fake reviews: Posting fabricated, incentivised, or retaliatory reviews
- Unauthorised access: Attempting to access accounts, systems, or data that do not belong to you
- Spam: Sending unsolicited messages or using the Platform for advertising unrelated services
- Circumventing fees: Arranging bookings or payments outside the Platform to avoid service fees
- Illegal activity: Using the Platform for any purpose that violates applicable laws
Violation of these rules may result in immediate account suspension or termination, and we may pursue legal action where appropriate.
10. Intellectual Property
The Juxtravel name, logo, design, software, and all associated content are the intellectual property of Hostsphere India Pvt Ltd and are protected by applicable intellectual property laws.
You retain ownership of content you create and share on the Platform (reviews, photos, Trip Board content). By posting content, you grant Juxtravel a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content in connection with operating and promoting the Platform.
You must not copy, reproduce, or reverse-engineer any part of the Platform without our prior written consent.
11. JuxAI Services
Juxtraveloffers AI-powered features ("JuxAI") including trip planning, property recommendations, and travel assistance. By using JuxAI, you acknowledge that:
- AI-generated recommendations and suggestions are provided for informational purposes and do not constitute professional travel advice
- AI features are powered by third-party services (OpenAI) and may not always produce accurate or complete results
- You should independently verify important details such as property availability, pricing, and travel requirements
- Juxtravel is not liable for decisions made based on AI-generated suggestions
12. Trip Boards
Trip Boards allow users to create collaborative planning spaces and share travel ideas. When using Trip Boards:
- Shared boards are accessible to anyone with the link. You are responsible for what you share.
- The board creator is responsible for the content posted on their board
- Juxtravel may remove boards or content that violates these Terms or our content guidelines
- Collaborative content contributed by others remains subject to the same content policies
13. Dispute Resolution
- Customer support: For any dispute regarding a booking or use of the Platform, please first contact our support team at hello@juxtravel.com. We aim to resolve all disputes amicably within 15 business days.
- Mediation: If a dispute cannot be resolved through direct communication, either party may request mediation through a mutually agreed mediator.
- Arbitration: If mediation fails, the dispute shall be resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be New Delhi, India.
14. Limitation of Liability
Juxtravel operates as a marketplace that connects guests with hosts. We do not own, manage, or operate the properties listed on the Platform. Accordingly:
- We are not liable for the condition, safety, legality, or suitability of any property
- We are not liable for the actions, omissions, or conduct of hosts or guests
- We are not liable for any loss, injury, or damage arising from your use of a property or the Platform
- Our maximum aggregate liability for any claim arising from your use of the Platform shall not exceed the total service fees you have paid to Juxtravel in the 12 months preceding the claim
The Platform is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
15. Indemnification
You agree to indemnify, defend, and hold harmless Hostsphere India Pvt Ltd, Juxtravel, and their officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- Your use or misuse of the Platform
- Your violation of these Terms
- Your violation of any rights of a third party
- Any content you post or submit through the Platform
16. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, any legal proceedings arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
